Merdeka lawsuit in UK August 30, 2007

By the time we clock off from work today to join the Merdeka celebrations, a Malaysian, Waytha Moorthy, who leads the Hindu Rights Action Front (HINDRAF), will be filing a public interest lawsuit at the English courts, asking the British government, among other things, 100 billion sterling pounds for “crimes against minorities”.
He is also claiming for:-
1. Damages of one million pounds per Indian in Malaysia for atrocities by the British and the ‘Malay Muslim’ government;
2. The British government to refer the Malaysian government to the International Court of Justice and the International Criminal Court for human rights violations and “mini genocide” against minority Indians;
3. Two million minority Indians in Malaysia to be granted British citizenship
4. The courts to declare that Malaysia is not an Islamic state
5. Tthe courts to declare that the Malaysian Constitution is null and void.
If the British court doesn’t throw this out on the basis of jurisdiction and friviality, this will be a very interesting case to watch.

Abdullah Ahmad Badawi better wake up from his snooze, get in touch with reality, and understand that racism and religious supremacism has no place in a civilized society.
This is a good one, I hope someone from the iban, kadazan and chinese community will follow suit, let’s make malaysia bankrupt.

Interesting that they’re asking for British citizenship…why not Indian?
Umno youth might be calling for repatriation of all Indians back to the ‘motherland’. They may say that the lawsuit is treason.
Idi Amin kicked Indians out of Uganda, but they were lucky and landed in Bradford. Malaysian Indians might not be so lucky and may end up in India instead – unless Hindraf thinks that is just as lucky.
I don’t see this as helping the cause of Indian Malaysians, rather seems more of a joke because they’ll still vote Samy Velu and BN and if the Maika AGM is anything to go by, Samy will keep on screwing them.
What a stupid lawsuit. Have any of you read the writ? The claims listed in Eli’s post seemed ludicrous, but possibly founded in fact, but after reading the writ, I find them completely detached from reality. I fear Haris Ibrahim was right to denounce HINDRAF as more concerned about Hinduism and Indians than Malaysians as a nation.

Splendid idea, if indeed you see the point that is made in the writ about the nature of Indian migration particularised as indentured labour. Malays should sue the British government for bringing in the Indians, but how far a Malay can lay claim to Malaysia as his ancestral home is purely historical and we quite know the history of Malaysia. What indeed Indians are suing for, is neglect by the Crown. It has nothing to do with land rights or the notional question of to whom Malaysia belongs. Malaysia is for Malaysians so far as they want to be such.
Therefore, those sections of the writ purporting that the British Crown has authority to remit Malaysia’s status to a non-Islamic state are impractical although probably not frivolous as that decision was not made by the Crown. But upping and leaving without a sideways glance, now that is something else.
Doctrinally speaking, if reliance is made on that imperceptible yet powerful notion of the ‘honour of the Crown’ (courtesy of the common law), then the British Crown owed a duty to act honourably when dealing with the rights of its subjects ie the Indians of Malaya when the Crown decided to quit its colony. That decision has affected the rights of Indians in Malaysia to this day due in part to the political immaturity of the major race of the country.
Malays sit down and don’t excite yourselves. If by some slim and barely visible chance the argument gets up, you can be rid of all the Indians in Malaysia in one fell swoop. Now wouldn’t that be nice? We know you’re thinking it. Suing a colonial government is not treason (only UMNO youth can think this one up). Treason would be suing your own government…oops, that wouldn’t be treason either! (Unless a Malaysian government says it is – and I wouldn’t put that past them).
Again, its not about Britain or India (in terms of nationality). It’s a question of the quality of that citizenship. If your Indian brethren feel discomfiture at the hands of what they considered to be unfair government – although that’s an argument for another day – stand up and be counted. You might be next. Sooner or later it won’t be about Malays or Indians or Chinese; it will be about the love of self. You can continue to labor under the illusion that your leaders identify themselves racially for now, but if you’re a poor Malay eking out a living in your kampong; you may be a cousin but you’re a very poor one. And what if you’re not even the same race as your leaders, what then?
Mr. Moorthy, pay particular attention to the honour of the Crown; you might just get up on it.

Well, as i know the indian been voting for the current gov. for the past 50 years.The fact that i know :Their equity drop from 3% to 1.5%, gov. job drop from 10% to 4%,education drop from 7% to 4%, population stastic drop from 10% to 7% and the tamil school stastic declined from 1000 to 523.Their crime rate increase from 5% to 24%. -reliable sources
So, if their indian leaders are not doing anything about this, why can’t the gov.(rep.all races) intervene to help the indians …as a MALAYSIAN!!!

Think who are we at 1st! we are not bumiputera as well, we are from indonesia. only thing we came earlier before they do! that’s it! chinese came as traders. Indians came as businessmen and cetti. only in Bristish colony they came as workers, We are not in any of this category. islam also not belongs to us. So we shouldnt be fanatic too. Think wisely.
these all are just jokes. I don’t know how the ppl of Hindraf can present most of those things to the British Government. I seriously think that they were laughing while doing that. “OMG, who wrote all these?? bad luck me to be the one to submit all these nonsense.” Doesn’t make sense for most of those claims………hahahhahaha………..im still LOL now. My friend, an Indian, felt so embarrassed when he came across this news.

Being a chinese, I never realise MCA ever helped in getting myself a job. Not to say that the party not doing anything, but there are many cases that when you needed help, the help is not there. The way you speak is pretty bias to each race, that many of us will not agree upon. In many ways, there is unfair treatment for each races in Malaysia.
